Lansing Car Accident Settlement For Serious Injuries

We recently settled a Lansing car accident lawsuit for a husband and wife from Holland, Michigan who suffered serious injuries in a car accident.  The accident occurred because the defendant driver crossed the median of the road and struck our clients car near head-on.  Both airbags deployed in the accident.

The clients contacted us just before the expiration of the statute of limitations for car accident cases in Michigan, which is three years from the date of the accident.  Had they waited any longer, there claims would have been destroyed.  The lawsuit was filed in the Ingham County Circuit Court.

The wife suffered lacerations to her knee and other injuries, including cellulitis and acquired lympedema.  She requires the use of a Lympa Press every day, seven days a week, and this takes up to two hours everyday.  She received a settlement for the insurance policy limits of $100,000 of the negligent driver.

The husband suffered a right knee sprain and a fracture of the metatarsal bone on his left foot.  He missed approximately six weeks from work.  He received a settlement of $20,000.00 for his injuries.

The clients were very smart and helped their own case by taking photographs of the damage to their vehicle after the accident.  They also took photographs of their injuries and bruising after accident and this was essential to helping their settlement awards.  Fortunately, they called our office just in time so that we could get their lawsuit filed.

Lansing Medical Malpractice Lawsuit Filed

We recently filed a Lansing medical malpractice lawsuit against a Lansing hospital and several Lansing area physicians.  The lawsuit was brough under the Michigan Wrongful Death Act and seeks damages for the family of a 54 year old woman who died from anesthesia complications while undergoing a routine outpatient procedure.  The suit alleges that her gastroenterologist, the anesthesiologist, and others were negligent in their care and this caused her death.

The woman suffered a respiratory arrest during the procedure and a full code was called to rescusitate her.  She was rushed to a local emergency room but by that time had suffered a hypoxic brain injury.  She was never able to come back from that injury and eventually died.

The suit was filed on behalf of her husband, three daughters, and her grandchildren.  Damages sought in this case include the loss of companionship suffered by the family, the loss of her income, and the loss of her services provided to family members at the home.  The suit contends that the death was preventable if the medical staff had properly monitored her during the procedure and taken necessary measures when her condition continued to worsen.  The case is currently pending in the Ingham County Circuit Court and no trial date has been set.

Lansing Police Car Accident

I heard a tragic story on the news a today about a man hospitalized do to a Lansing Police Car Accident on Wednesday, October 21st in Ingham County. According to the family of the injured man, his brother was allegedly turning on to Martin Luther King Boulevard, from Kelsey Avenue, when they were allegedly hit by the police car.

According to the driver, the police car allegedly did not have its lights on or its siren running as it sped down MLK, allegedly on its way to answer a call. The passenger in the car suffered serious injuries as he was thrown 30 feet through the driver side of the window and is in critical condition at a local hospital. The Michigan State Police are investigating this accident.

I  am very sorry to hear about this tragic auto accident and wish the injured man the fullest and speediest recovery possible.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the injured man can submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover his medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.  The injured party can claim these benefits even if they did not have a Michigan automobile insurance policy.

In addition, the car accident injury victims may also have claims for personal injuries against any driver determined to be at fault in this auto accident as well as a possible claim against the City of Lansing. The insurance company for the negligent driver typically pays a settlement for this type of case. In this lawsuit, the injured victim can claim damages and compensation for the injuries suffered in the accident.  At the very least, the injured parties should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victims with this type of claim.  Auto accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Lansing Dog Bite Lawyers

Our Lansing dog bite lawyers represent victims of dog bites and attacks.  Many of the victims of these attacks are youn children.  In fact, children who are younger than 10 years represent the high-risk group for dog attacks.

In particular, children tend to underestimate the danger arising from dogs because they are more inexperienced than adults in their interaction with dogs. This is confirmed by studies showing that children are more likely than adults to sustain canine bite wounds.   They are also more likely to approach strange dogs or to attempt to pet a dog than an adult.

The injuries suffered by a child from a dog bite are often very serious. Children are frequently bitten in the facial region and require plastic surgery later on in life.  Depending on the age of the child at the time of the attack, many surgeons will not perform surgical revisions until the child reaches early adulthood.  This means that many times, children will go through the embarrassment and humiliation of the scar through adolescence, a period in which they are very self-conscious of their appearance.

The consequences of a dog bite trauma often have an affect on a child and for years after the incident.  This often impacts them both socially and emotionally.  Many child dog bite victims even suffer from post-traumtic stress syndrome and have nightmares about their attack.  Hence, dog bites of children represent a serious medical and public health issue.

Child dog bite victims do have legal rights to pursue compensation for their injuries.  This includes payment of medical expenses, plastic surgery expenses, and for their psychological damages suffered from the attack.  This includes the affect that a scar has on a child’s self-esteem.  The owner or keeper of the dog is liable for these damages under Michigan law.

For more information on the rights of dog bite victims, call us at (800) 606-1717 and request our FREE book, “The Ultimate Michigan Dog Bite & Animal Attack Handbook.”  We’ll send it out right away.

No-Fault & Uninsured Motorist Insurance Settlement

We recently settled an Ingham County lawsuit for clients who were injured in a Lansing area car accident.  The accident victims were a husband and wife who suffered shoulder injuries when their car was struck by an uninsured driver.  The uninsured driver was negligent and caused the accident.

Our clients had their auto insurance policy through Auto Owners Insurance Company.  Their policy provided for Michigan No-Fault Insurance Benefits and Uninsured Motorists Benefits.  The insurance company underpaid some benefits and neglected to pay required medical expenses.  Through the settlement, they agreed to pay the medical providers their fees and charges related to the injuries suffered in the car accident.

Because the negligent driver was not insured, we made a claim for Uninsured Motorists Benefits for the accident victims against their own policy.  These claims were for their personal injuries suffered in the accident.  The insurance company paid a settlement for these benefits as well.

This case demonstrates the importance of drivers in Michigan purchasing uninsured motorist coverage on your auto insurance policy.  Because there is a significant number of uninsured drivers in Michigan, it is necessary to have this coverage to protect yourself in the event of an accident.
